The office of the
Maharashtra Administrative Tribunal was constituted in the year 1991. The service disputes
of the Maharashtra Government servants were initially conducted by way of filing Writ
Petitions in Bombay High Court. However, as the Bombay High Court was over burdened with
the other matters Maharashtra Administrative Tribunal was formed for the
expeditious redresal of the service disputes of Government servants.
A Government Servant who is aggrieved by the action of his
Department/Government against him has to approach this Hon`ble Tribunal for getting
justice. The Government Servant cannot approach other Courts directly. The Government
Servant who is aggrieved is called as Applicant and the Department/Government who had
taken action is called as Respondents. The Applicant has to appoint his Advocate to
represent his case before the Hon`ble Tribunal. And for Respondents the reasons and
justification of action taken against the Applicant by the Respondents is represented
through Presenting Officers before the Tribunal.
The Applicant has to file Original Application for redressal of his
grievances and the Respondents have to give reply (Affidavit in Reply) to the Original
Application so as to clarify the reasons for initiating such action against the Applicant.
If the Hon`ble Tribunal is satisfied it delivers order/judgment or else it gives time to
produce relevant documents and/or directs to justify some of the queries.
If the Applicant finds that the Affidavit in Reply filed by the
Respondents is vague or improper, he can file a Rejoinder to clarify his say. Again the
Respondents have to answer the Rejoinder i.e. to file Sur-Rejoinder.
Some times the Applicants wish to amend Original Application to make
some changes or add some contents. The Applicant has to file Miscellaneous Application for
the same. The Respondents have to answer the Miscellaneous Application.
After delivering order/judgment the parties who are aggrieved of the
judgment delivered by the Hon`ble Tribunal may again approach this Hon`ble Tribunal by way
of Review Application. If the Review Application is filed by the original applicant then
the respondents have to file their reply, which is placed before the Hon`ble Tribunal
through Presenting Officers.
If the order/judgment is in favor of the original applicant and the
respondents disobeyed the said order/judgment or failed to comply the orders of the
Hon`ble Tribunal within stipulated time, the original applicant may approach this Hon`ble
Tribunal by way of Contempt Application for aforesaid reason. The Respondents have to file
proper reply narrating reasons for failure to comply the orders of the Hon`ble Tribunal.
After delivering the order/judgment in Original Application and/or
Miscellaneous Application and/or Review Application the parties who are aggrieved by the
judgment delivered by the Hon`ble Tribunal may approach higher forum i.e. High Court for
redressal of their grievances.
